The Process for an Undefended Divorce

Step 1 - There is only one ground for a Divorce in England and Wales and that is that the marriage has irretrievably broken down. This needs to be demonstrated by proving one of the following five facts:

  1. Adultery
  2. Unreasonable behaviour
  3. Desertion
  4. 2 years separation with consent
  5. 5 years separation without consent

Step 2 - A Divorce Petition is prepared stating some background information and the reasons for the divorce.

Step 3 - Divorce papers are filed with the Court with the relevant fee and any supporting documentation.

Step 4 - The Respondent has 7 days to acknowledge receipt of the papers by completing an Acknowledgment of Service Form.

Step 5 - Decree Nisi:

A Certificate is obtained from a judge to confirm that the parties are entitled to a Decree of Divorce.

Step 6 - Decree Absolute:

  • This is the final Divorce Order which can be applied for 6 weeks and 1 day after the Decree Nisi.
  • Decree Absolute is then pronounced usually within a week.
