Pre-nuptial agreements used to have a bit of a reputation. People often saw them as something linked to celebrities, huge amounts of money, or couples already expecting things to go wrong. That\u2019s not really the case anymore.<\/p>\n
These days, plenty of couples decide to put something in writing before they get married. Usually, it\u2019s less about mistrust and more about avoiding uncertainty later on.<\/p>\n
For some, it\u2019s about protecting a business they built before the relationship. For others, it could be family money, property, savings, or children from a previous relationship. Sometimes people just want everything out in the open before they get married.<\/p>\n
A pre-nuptial agreement is a document signed before marriage which sets out how finances would be dealt with if the relationship later broke down.<\/p>\n
That can include things like:<\/p>\n
It\u2019s basically a way of agreeing how certain financial matters would be approached if things didn\u2019t work out in the future.<\/p>\n
Most people hope it never becomes relevant.<\/p>\n
Not automatically. In England and Wales, the court still has the final say. But prenups are taken far more seriously than they used to be, especially when they\u2019ve been prepared properly.<\/p>\n
Usually, the court will look at whether:<\/p>\n
Trying to rush one through days before the ceremony is rarely a good idea.<\/p>\n
A lot of the time, people just want clarity. Money conversations can be uncomfortable, but avoiding them doesn\u2019t necessarily make things easier later. A prenup gives couples the chance to talk openly about finances before they get married, rather than trying to untangle everything during a stressful separation years down the line.<\/p>\n
For some couples, it also removes a layer of worry. If one person is bringing significantly more assets into the marriage, or there\u2019s family wealth involved, having something agreed early on can help avoid arguments later.<\/p>\n
There are still limits. A prenup can\u2019t decide arrangements for children, and it can\u2019t completely remove the court\u2019s ability to look at what\u2019s fair at the time of separation.<\/p>\n
If circumstances have changed dramatically over the years, the court can still take that into account.<\/p>\n
It\u2019s probably more common than you think…<\/p>\n
A lot of couples quietly put prenups in place now. Not because they\u2019re planning for divorce, but because they\u2019d rather deal with difficult financial conversations while things are good, calm, and straightforward.<\/p>\n
